SPECIFIC RULES OF THE 6UP GAME OF SKILL 

    SECTION I 

    INTRODUCTION 

6UP is a fantastic new skill game that adds thrill to watching Cricket: use your cricket related knowledge and skill to determine the runs for each ball in an over – determine the first 6, 5, 4 valid balls or the Runs per Over (RPO) correctly and your skill will earn you instant rewards. 

How 6UP Works: 

It’s simple. 

As you’re watching cricket, evaluate how many runs the batsmen are likely to make in the over (the RPO) - then - just send us a SMS message describing how you see these runs coming about during the over – in other words, the runs for each ball. 

So if you determine that the RPO for the next over will be Twelve (12) and the runs will come in boundaries, you would text us something like 444000. 

How you sequence each of the 6 balls depends on your reading and evaluation of the cricket match, which you play live in real time along with the match. 

To play in an over, you text us your 6 ball entry and we reply back confirming: your Entry (ball-by-ball and RPO), your over of play, the live match score and the current value of the prize you are playing for. 

You then watch your over play out and see just how accurate your Entry for the over is. 

If you are a winner we will text you confirming that: you’ve won, exactly how much you have won and how to collect your win. All winners will be paid via cheque, irrespective of their win amount. A winner will receive a cheque worth of his/her win amount once the total win amount exceeds Rs200.00. A small administrative fee, not exceeding Rs35.00, will be deducted from win amount exceeding Rs.1,000.00.

6UP is played along with live cricket, allowing every Participant to take into consideration all match conditions prior to making an Entry. 

In this way, participants have an insight into everything that’s happening in the match right at the moment they want to play. It is the only game of it’s kind in the world engineered to enable participants to participate in the game in true, real time and utilize their skill to the extreme. 

There are three main areas of skill that participants can apply to 6UP and each level has a major impact on the likelihood of success. They are: 

1.  Your basic cricket knowledge

2.  Your basic knowledge of a particular cricket match and teams playing the match

3.  Your understanding of the live cricket match and various factors and conditions affecting the match, including past and current performance of the players.

 

    SECTION II 

    TERMS AND CONDITIONS OF THE 6UP GAME OF SKILL 

  1. These rules are the general terms and conditions ("Terms and Conditions") that apply to the skill-based game called "6UP" that may be accessed and played with the aid of mobile handset device by sending SMS / WAP @ designated access codes across India in relation to live cricket matches ("Game"). By entering the Game, entrants agree to be bound by these Terms and Conditions. If you do not accept these Terms and Conditions, please do not enter the Game. These general terms and conditions are applicable from 1st September 2009.
 
  1. Before entering the Game, please refer to the specific rules relating to the Game displayed on the www.play6up.in web page ("Specific Rules").
 
  1. Revo Content Services Private Limited, a company incorporated in India which owns and operates 6UP ("6UP") reserves the right to cancel or modify the Game, and amend the Specific Rules or these Terms and Conditions at any time without prior notice. Any changes will be posted either within the Specific Rules or these Terms and Conditions. If you do not accept any changes to these Terms and Conditions, please do not continue to participate in the Game.
 
  1. In the event of any dispute regarding the Terms and Conditions, Specific Rules, conduct of the Game, results and any other matter relating to a Game, the decision of 6UP shall be final and no correspondence or discussion shall be entered into.

 


Qualifying Entrants  

  1. The Game is open to residents of India aged 18 years or above other than those persons specified in clause 6 below. Eligibility and entitlement as to prizes may change for regulatory reasons in which case the Terms and Conditions shall be amended accordingly. You agree that 6UP shall not be held liable in the event that any persons are subsequently excluded from the Game as a result of any regulatory direction or applicable law.

 

  1. Employees and agents of any sponsor or promoter of the Game, 6UP or any advertising agency, web company connected with 6UP (“Specified Companies”) or any subsidiary or associated company of the Specified Companies, as well as members of their families or households, are not eligible to enter the Game. 6UP reserves the right to verify the eligibility of all entrants.
 
  1. 6UP will assume (and by entering the Game you warrant) that you have legal capacity to enter into the agreement set out in these Terms and Conditions (i.e. that you are of sufficient age and mental capacity and are otherwise entitled to be legally bound in contract).
 
  1. By entering the Game, you:
        1. warrant that you have read and understood these Terms and Conditions and the Specific Rules;
        2. warrant that all information submitted by you is true, accurate, current and complete;
        3. accept that all entries and any intellectual property rights subsisting therein, which are received by 6UP will become the property of 6UP and will not be returned, subject to applicable law; and
        4. warrant that your entry does not defame, cause injury or invade the privacy of or otherwise infringe or violate any applicable law, regulation, custom or intellectual property rights of any third party.
 
  1. 6UP reserves the right to disqualify or exclude any entrant from the Game and withhold prizes if it has reasonable grounds to believe the entrant has breached any of these Terms and Conditions and/or the Specific Rules.

 

  1. In the event that any entrant is disqualified from the Game, 6UP may in its sole and absolute discretion select another winner from entries received before the specified closing date and time on the same criteria as the original entrant who will be subject to these Terms and Conditions and the Specific Rules.
 

Game Entries  

  1. You may participate in 6UP via the particular access code as per Your telecom service provider, the list of which will be available on the 6UP website and which may be updated from time to time. All Game Entries will be charged at Rs. 5 subject to variation from time to time as posted on the 6UP Website. Only valid 6UP entries as per the Specific Rules will be accepted. 6UP and all sponsors of the Game shall not be liable for any damage, loss, injury or disappointment suffered by any entrant as a result of sending an invalid entry. There will be no refund of sms charge for invalid entries.
 
  1. Game entries must be completed in full and made in the manner set out herein and in the Specific Rules any time after the commencement of the match until the cut-off time for an over of such match.
 
      1. The coin toss must precede the opening of a 6UP Match.  Providing that the coin toss has occurred and that the previous 6UP Match has ended, the 6UP Match will commence 20 minutes prior to the scheduled start time of the cricket match.
 
      1. The cut-off time means the time before which 6UP's systems must receive and process the entry and is set at 6UP’s discretion as close as possible to the time when the bowler first rolls over his arm to bowl the first ball of an over, whether or not the ball is actually bowled. No further entry(ies) to that over will be accepted thereafter. At this point any entries received will be considered as entries for the following over. In playing 6UP, you accept that there may be delays in transmission and processing of entries and in transmission of the match that may cause an entry sent before the bowler bowls to miss the cutoff time for that over and the entry will be accepted for the following over. In the case that there is no more 6UP over(s) in the 6UP Match, the entry will be deemed invalid.
 
      1. Entries for the a 6UP Over will only be accepted (if it is a 6UP Entry as defined herein) within the time period commencing at the Cut-off time of the preceding over (or the opening of the 6UP game in the case of the first over of the match) and ending at the Cut-off Time for 6UP Over in respect of which the entry is being made.
 
  1. 6UP does not accept responsibility or liability for any failure to receive entries whether caused by any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, server functions, virus, bugs, technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or traffic congestion on the mobile networks, or at any web site, or any combination thereof. If the Entries are not received before the Cut-off Time due to any such problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or traffic congestion on the mobile networks, or at any web site, or any combination thereof, such Entries will be deemed invalid.
 
  1. Each participant can send in a maximum of twenty (20) entries per innings per cricket match. Any unused entry(ies) in respect of a particular innings cannot be carried forward to the next innings. Entry(ies) above the 20 maximum will be deemed invalid. 

  
Prizes  

  1. Please see the Specific Rules for details of the prizes and the basis of their award.
 
  1. The win amount will be paid out of the price charged for entries sent through SMS. From the SMS charge, Revo pays the telecom service providers for the provision of a shortcode. And once the value of entries exceeds the Prize Minimum stated above, the 6UP win amount will grow by a minimum of Rs.2 with each additional entry received. For further details please refer to the 6UP website www.play6up.in
 
  1. In all matters, the decision of 6UP shall be final and binding. No correspondence or discussion shall be entered into.
 
  1. The telecom service provider is in no case liable for distribution of Prizes and no dispute should come to them in this regard.
 
  1. Prize winners will be notified by SMS within seven (7) days of determination as winners.
 
  1. Return of any prize notification as undeliverable, the participant not being contactable by phone within three attempts and/or failure to claim the prize(s) within 15 days of the prize notification shall result in disqualification of the entry and the sms charge and any prize amount will be forfeited. For details on prize notification, refer to the Specific Rules.
 
  1. Failure to claim a prize as specified in Clause 18 within the time or manner notified may result in disqualification. All entitled winners who qualify as per the Specific Rules shall receive their prize(s) within 90 days of the date of the determination of winners. Should a winner not receive his/her prize within this time then he/she should contact 6UP directly by email at 6up@iplayup.in. All claimed prize(s) are valid for 180 days from the date of the determination of winners, after which the sms charge and any prize amount will be forfeited.

 

  1. Prizes are non-transferable and there is no alternative. 6UP reserves the right to substitute prizes which may not be of equal value at any time.
 
  1. 6UP reserves the right to request (i) documentary proof of residency and/or age of any winner; (ii) execution of release of liability and acknowledgement forms (in form and substance satisfactory to 6UP); and (iii) such other relevant documents viz. copies of PAN cards etc. before any prize is dispatched. If such documents are not provided to the satisfaction of 6UP, 6UP reserves the right to disqualify such person and not dispatch the prize and the prize will be forfeited.

 

  1. In the event that any prize or receipt thereof incurs any tax liability, such tax shall be borne by and is the sole responsibility of the prize winner.

 

  1. Prizes are awarded on an “as is” basis without warranty of any kind from 6UP, express or implied, save where this would be contrary to applicable law. Actual prizes by 6UP, and any of its sponsors, may differ from those shown anywhere in or during the contest. Entrants shall not make any claims or demands in this regard.

 
Liability  

  1. To the maximum extent permitted by applicable law, 6UP and all sponsors of the Game shall not be liable for any damage, loss, injury or disappointment suffered by any entrant entering the Game or as a result of inability to participate in the Game, or the acceptance or use of any prize. You expressly understand and agree that your use of the Game website and your participation in the Game is at your sole risk. 6UP and all sponsors of the Game are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the mobile networks, or at any web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials in the Game.
 
  1. By entering, participants agree that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted against the Specified Companies, their parent companies, affiliates, directors, officers, employees or agents for any and all losses, damages, rights, claims and actions of any kind resulting from entry into the Game, inability to participate in the Game, or acceptance or use of any prize.

 
Indemnity  

  1. You agree to indemnify and keep indemnified 6UP and all sponsors of the Game, including their officers, directors, employees, agents, distributors and affiliates from and against any and all claims, loss, damage or liability suffered and fees and costs incurred, including reasonable legal fees, resulting from any act, neglect or default or breach by you or any person who may be authorized by you or for whom you are responsible of any of these Terms and Conditions and/or from your placement or transmission of any content onto 6UP’s servers and/or from any and all use of your account.

 
Data Protection and Publicity  

  1. By entering a Game, NDNC registry is not applicable and entrants agree to receive promotional messages from 6UP as 6UP and the sponsors may in their sole and absolute discretion decide.
 
  1. By entering a Game, entrants agree that should they win the Game, 6UP and the sponsors of the Game may use, without further charges and without further notice, their names and addresses, photographs and audio and/or visual recordings of them in any publicity or promotional material as 6UP and the sponsors may in their sole and absolute discretion decide.
 
  1. 6UP shall solely and absolutely enjoy all rights over the information/ data sent by you (including the contents of your SMS entries, personal data etc.) and received by 6UP on account of your participation in the Game. You confirm that you have no-objection to 6UP receiving, recording, maintaining and using such information/ data in any manner that 6UP decides.

 
Intellectual Property  

  1. You acknowledge and agree that all copyright and trade marks and all other intellectual property rights in the SMS content/ WAP/ website and all material or content related to the Game shall remain at all times owned by 6UP. All material and content contained within the 6UP website is made available for your personal non-commercial use only and you acknowledge and agree that you may download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content on the 6UP website/WAP site and/ or the information disseminated by SMS or other means of communications is strictly prohibited.

 
Governing Law and Jurisdiction 

  1. This Game and the Terms and Conditions shall be governed in all respects by the laws of India and the courts in Delhi shall have exclusive jurisdiction in respect of any dispute arising under these Terms and Conditions.

 

  1. Each entrant is fully responsible for ensuring that his/her participation in the Game is lawful in accordance with the laws of India. None of the Specified Companies, their servants or agents make any representations, express or implied, in relation to any entrant's participation in a Game.
 

 

SECTION III 

SPECIFIC RULES OF THE 6UP GAME OF SKILL 

Please read and understand the following provisions of 6UP Rules carefully. By participating in the game, You are agreeing to comply with and be bound by the following terms and conditions (the "Rules of the 6UP Game of Skill"). It is clarified that terms and conditions applicable to the 6UP Game of Skill subject to which subscribers may participate in the 6UP Game of Skill includes the terms and conditions published in newspapers from time to time, and those contained herein in the Specific Rules.  

1. Definitions 

    In 6UP Rules the following words are defined as under: 

    6UP means Revo Content Services Private Limited, its affiliates and successors, along with employees and agents of any sponsor or promoter of the 6UP Game of Skill, any advertising agency connected with 6UP Game of Skill.  

    6UP Game of Skill means the skill based SMS and/or Wireless Application Protocol (WAP) game called "6UP".  

    6UP Match means a selected one day cricket match, twenty/twenty cricket match in respect of which the 6UP Game of Skill may be played and is open for entries, as listed on the 6UP Website and Wireless Application Protocol (WAP) site. 

    6UP Over means a selected cricket over for which 6UP Game of Skill may be played, each of which is listed on the 6UP Website and WAP site. 

    The Nominated Charity is the Steve Waugh Foundation in India. 

    Cut-off Time means the time before which 6UP’s systems must receive and process the Entry in respect of any particular 6UP Over and is set at 6UP's discretion as close as possible to the time when the bowler first rolls over his arm to bowl the first ball of such 6UP Over, whether or not the ball is actually bowled.  No further Entry(ies) to that 6UP Over will be accepted thereafter.  In playing the 6UP Game of Skill, you accept that there may be delays in transmission and processing of entries and in transmission of the match that may cause an entry sent before the bowler bowls to miss the cutoff time for that 6UP Over and you agree that 6UP shall not be held responsible or liable for any such delays in any manner whatsoever. 

    Eligible Participant(s) or Participant(s) means any person who is not an Ineligible Person(s) and fulfills the eligibility requirements set out in the Terms and Conditions of the 6UP Game of Skill including but not limited to being 18 years and above in age, being citizen of India who is resident in India and subscriber of the cellular mobile service operator(s) that carries the 6UP Game of Skill.  

    Ineligible Person(s) means any of the following persons:  

    1. The directors, employees of the cellular mobile service operator(s) that carry the 6UP Game of Skill or its agents and the family members of each such director or employees.
    2. The directors, employees of 6UP or its agents and the family members of each such director or employees.
    3. each cricket player who is a member of either team (including its wider squad) taking part in the 6UP Match, and the family members of any such player, all officials, including but not limited to supervisors who are responsible to record and manage the scores, match managers who has associated with any or all 6UP Match(es) and their family members.
    4. the user(s) of 6UP Game of Skill making an ineligible Entry. 
 

    Entry or 6UP Entry means the SMS or WAP entry sent by the Participants being a valid entry in accordance with the Terms and Conditions and the 6UP Rules.  

    Match Commencement means the time at which a 6UP Match is deemed to have commenced. The coin toss must precede the opening of a 6UP Match.  Providing that the coin toss has occurred and that the previous 6UP Match has ended, the 6UP Match Commencement will be 20 minutes prior to the scheduled start time of the cricket match.   

    Matching Rule, means, the rule applied by 6UP in its absolute discretion, to each 6UP Over, to determine the number of balls that must be matching for a valid 6UP Entry. Upon determination of each Matching Rule, the remaining percentage of the Prize will be carried forward to next 6UP Over. In the case that an over ends before six balls are bowled, the unbowled balls shall be counted as 0(zero) only.  

    For example, a 6-ball Matching Rule or 6UP means that the Entry in respect of all six balls of the 6UP Over must be correct, for example result of over was 121112 and the Entry is 121112;

    a 5-ball Matching Rule or 5UP means that the Entry in respect of the first five balls must be correct, for example result of over was 121112 and the Entry is 121113.

    a 4-ball Matching Rule or 4UP means that the Entry in respect of the first Four balls must be correct, for example result of over was 121112 and the Entry is 121133.

    a RPO matching rules or RPO means that the Entry in respect of the runs per over must be correct for example result of over was 121112 with RPO of 8 and correct Entry is 8. 

    The Payout Percentage for all 6UP Matches shall be as under:

     

  • For 6-Ball Matching Rule winner(s) receives/shares 100% of Prize of the 6UP Over.
  • If there is no 6-Ball Matching Rule winner, then for 5-Ball Matching Rule winner(s) receives/shares 40% of Prize. The remainder of the Prize amount will roll-over into the win amount for the next 6UP over.
  • If there is no 6-Ball Matching Rule winner and no 5-Ball Matching Rule winner(s), for 4-Ball Matching Rule winner(s) receives/shares 30% of Prize. The remainder of the Prize amount will roll-over into the win amount for the next 6UP over.
  • If there is no 6-Ball, or 5-Ball or 4-Ball Matching Rule winner, then the correct Entry(ies) of total runs of a 6UP over receives/shares 20% of Prize. The remainder of the Prize amount will roll-over into the win amount for the next 6UP over.
  • In the event that there are more than one winner(s), under any Matching Rule, the prize money is divided equally amongst the winners.
  • In the event that there are no winner(s), under any Matching Rule in a given 6UP over, the entire win amount will roll-over into the win amount for the next 6UP over.
 

    Prize means, the prize amount to the winners which shall be shared equally among all winners of a 6UP Over. If the win amount per player drops to below Rs.5 then the win amount will be adjusted up to Rs.5 per winner and will reduce the roll-over win amount accordingly. 

    The minimum Prize share for each 6UP over shall be as advertised on the 6UP website and is subject to change from time to time at the sole discretion of 6UP. ("Prize Minimum") It is the responsibility of the 6UP Game of Skill Participant to refer to the website for notification of such changes.>

    The win amount will be paid out of the price charged for entries sent through SMS. From the charge, Revo pays the telecom service providers for the provision of a shortcode. And once the value of entries exceeds the Prize Minimum stated above, the 6UP win amount will grow by a minimum of Rs.2 with each additional entry received. Details of the win growth amount as per your particular service provider will be available on the 6UP website and which may be updated from time to time. 6UP reserves the right to amend win growth amount stated herein. Changes in the win growth amount will be notified via the 6UP website www.play6up.in <http://www.play6up.in/>. It is the responsibility of the 6UP Game of Skill Participant to refer to the website for notification of such changes. 
     

    Rounding of the prize amount is calculated by using 2 decimal points and truncating the remainder. 

    6UP reserves the right to amend this Prize Minimum amount at its sole discretion. Changes in the Prize amount will be notified via the 6UP website www.play6up.in. It is the responsibility of the 6UP Game of Skill Participant to refer to the website for notification of such changes. 

    SMS means Short Message Service. 

    You or you means each person who plays the 6UP Game of Skill. 

  1. General Terms and conditions
 
    1. The information contained in 6UP Rules is being provided by 6UP for the purposes of enabling the subscribers to participate in the 6UP Game of Skill and for no other purpose.
 
    1. 6UP Rules provides information on the scope, restrictions and limitations of the 6UP Game of Skill.
 
    1. Only subscribers of the telecom service provider(s), on whose network the 6UP Game of Skill in India is available, can participate in the 6UP Game of Skill. 6UP is the organizer of this competition and the telecom service provider has allotted 6UP the short code for this purpose.
 
    1. 6UP Rules is a summary of available information and no representation or warranty, expressed or implied, are made in relation to such information and no liability is or will be accepted by 6UP, its respective advisors, consultants, contractors, and its agents in relation to the accuracy, adequacy or completeness of such information or statements made nor shall it be assumed that such information or statements will remain unchanged.
 
    1. Nothing in the 6UP Rules shall be construed as legal, financial or tax advice.
 
    1. 6UP will not be liable for any costs, expenses, taxes however so incurred by you on account of participating in the 6UP Game of Skill. 6UP reserves the right to amend, modify or remove one or more clauses of this 6UP Rules and any information contained herein at any time without prior notice. The updated 6UP Rules will be posted at the Website http://www.play6up.in and at the outlets of our distribution partner. You should regularly check this Website for any and all updates and changes.
 
    1. Neither the information in the 6UP Rules nor any other written or oral information in relation to the 6UP is intended to form the basis of or the inducement for any investment activity or any decision to enter into any contract or arrangement.
 
    1. Nothing in the 6UP Rules is, nor shall be relied upon as, a promise or representation except otherwise provided herein.
 
    1. Any summaries or descriptions contained in any part of the 6UP Rules are indicative in nature.
 
    1. 6UP, its respective advisers, consultants, contractors, and agents do not accept any responsibility for the legality, validity, effectiveness, adequacy or enforceability of any act, deed, omission made by the  participants without having understood 6UP Rules.
 
    1. Each Participant who participates in the 6UP Game of Skill shall be construed/ assumed to have fully understood and accepted the 6UP Rules. This Disclaimer is part and parcel of the 6UP Rules.
 
    1. The Terms and Conditions and the 6UP Rules constitute the entire and the only agreement between you and 6UP, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the 6UP Game of Skill.
 
    1. 6UP shall have no liability whatsoever to You or any third party in respect of any errors or omissions in the provision of the 6UP Game of Skill nor in respect of any of the contents of the Website, and at the outlets of our distribution partner for any indirect or consequential loss, loss of business, revenue, profits, or saving which any participant expected to make, or financial loss of any sort.
 
    1. 6UP Game of Skill is only offered for the Eligible Participants (as defined hereunder) who are Citizens of the Republic of India residing in India.
 
    1. 6UP does not accept any responsibility for delays caused by mobile network and / or ISP congestion and / or mobile handset failure or any other technical, operational or telecommunications failure.
 
    1. Any attempt by any individual, body corporate, to damage, destroy, tamper with or vandalize the 6UP Game of Skill, or any portion therein, or otherwise interfere with the operation of the 6UP Game of Skill, may be a violation of the laws of India and 6UP reserves the right to diligently pursue all remedies as may be available in this regard against any offending individual or entity to the fullest extent permissible by law.
 
    1. Any personal information You provide to 6UP is confidential subject to its disclosure as per applicable law and, or as per the requirement stated herein. The information 6UP collects may include Your name, Your postal and email address, and Your telephone number, both home and mobile and your date of birth, PAN details and any other details as it deems fit. The telecom service provider does not disclose/share any personal subscriber information with 6UP
 
    1. Failure by 6UP to enforce any of these 6UP Rules does not constitute a waiver of its right to do so.
 
  1. How to play 6 UP
 

    The 6UP Game of Skill is a game of skill for the Participant(s) who possess knowledge and skill in relation to cricket. The Participant(s) shall evaluate and answer as to what will happen on each ball of a selected 6UP Over of a 6UP Match and as stated in the terms and conditions stated herein.  

    You can only play 6UP during the period from the time of the 6UP Match Commencement until the Cutoff Time of the last 6UP Over.  

    Example: The 6UP Match is open for 6UP in the following manner:

      1. The toss occurs and the winning team decides to bat first, any previous 6UP Match is complete and it is 20 minutes prior to the scheduled start time of the match. The 6UP Match is now considered to have commenced and from then on entries will be accepted for the designated 6UP over of the designated 6UP Match.
      2. In the event the designated 6UP Match has commenced, then the game is open for You for a designated 6UP Over until the Cutoff Time.
      3. In the event that there is no designated 6UP Match or designated 6UP Over at any time during the series Your entry will not be accepted.
      4. 6UP is only available on an over that is a 6UP Over.
      5. In the case that a prior 6UP Match has not finished when a second match starts that was announced as a 6UP Match, You will only be able to play in the first 6UP Match until it is completed. The second 6UP match will be open for you to play the 6UP Game of Skill only after the first 6UP match is completed. 6UP may in its sole and absolute discretion choose to change the valid 6UP match at any time without prior notice.
 

    Each 6UP Entry shall be applicable to one 6UP Over only. You may play 6UP on each 6UP Over as often as You choose, but limited to 20 entries per innings of an 6UP Match. Each Entry, including duplicate/ multiple entries, will be charged as below. Any unused Entry(ies) in a particular innings cannot be carried forward to the next innings. 

    Entry via WAP and SMS to the relevant short code as advertised on the 6UP website http://www.play6up.in is charged at a premium rate to an ordinary SMS, Indian Rupees (INR) 5/- (Indian Rupees Five only), subject to variation from time to time as posted on the 6UP Website, WAP site and/or available at the outlets of our distribution partner. You hereby authorize 6UP to adjust the sms charge for your Entry from your existing mobile telephone account with relevant operator, from whose network the SMS for the Entry originates.  

  1. A valid 6UP Entry
 
    1. A valid 6UP Entry is a sequence of six numerical characters. An example of a valid 6UP Entry is “401162”. It interprets as follows:
      1. four runs scored from the first valid ball of 6UP Over;
      2. no runs scored from the second valid ball of 6UP Over;
      3. one run scored from the third valid ball of 6UP Over;
      4. one run scored from the fourth valid ball of 6UP Over;
      5. six runs scored from the fifth valid ball of 6UP Over; and
      6. two runs scored from the last valid ball of 6UP Over.
 

    (b) The runs may be scored through runs from the bat or glove, overthrows, leg byes or byes. You need to answer the number of runs scored on the ball on which a wicket might also fall. For example, if the batsman is clean bowled, You need to answer the runs scored on that ball as 0 (zero) and if the batsman gets out as run out and 1 valid run was scored on that ball, then You need to answer 1 (one) run for that ball. 

  1. Only first six numerical characters entered will be considered valid and accepted as a valid 6UP Entry. For example, if the Entry received is “21041166”, it shall be accepted as “210411” as a valid 6UP Entry.
 
  1. An 6UP Entry that is shorter than six numerical characters is completed with trailing zeroes. For example, if the Entry received is “2141”, it shall be accepted as “214100” as a valid 6UP Entry.
 
  1. All dots or spaces between the numbers in a 6UP Entry shall be accepted after removing the dot or space between the numbers. For example, if the Entry received is “2.1.4.0.1.1” or “2 1 4 0 1 1”, it shall be accepted as “214011” as a valid 6UP Entry.
 
  1. A blank 6UP Entry is accepted as all zeros (000000) or a maiden over (with or without wickets).
 
  1. Other than the Entries illustrated above, any other text whatsoever in nature will be deemed invalid.

     

  1. An Entry is valid for valid balls bowled only. A valid ball is a ball which does not cause any extra ball to be bowled for that 6UP Over. Wides and no balls including the run(s) scored from them shall be ignored for the purposes of a 6UP Over entry and the score for the next valid ball will be accepted. For example Your 6UP entry for an over was 464000 and the first three balls score is 4-6-4 followed by a wide, the wide will not be scored as a run for the purpose of the 6UP Game. If the next three valid balls are 0-0-0 the winning 6UP entry would be 464000.
 
  1. If in a 6UP Over, an umpire erroneously declares an over bowled, i.e. (a) declares over bowled with less then 6 balls being actually bowled; or (b) declares over bowled after more then 6 balls of the over has already been bowled. In such an event the effect of the validity of the 6UP Over and runs scored shall be calculated as per sub-clause (d) and (c) of clause 4 respectively herein.
 
  1. Not all 6UP Overs may be bowled in a 6UP Match, for various reasons (including weather, bad light, one team is bowled out or one team wins before the allocated overs are completed or any other reason whatsoever). Accordingly, if a 6UP Over is not bowled in the innings, this shall result in the entry being deemed invalid.
 
  1. If a 6UP Match is completed/abandoned before completing the 6UP Over, in such an event the effect of the validity of the 6UP Over and the entry shall be completed with trailing zeroes. For example, if the runs scored before the early end of the over is “2141”, it shall be accepted as “214100” as a valid 6UP Entry.
 
  1. 6UP is timed as closely as practicable to the actual match timing. A live television broadcast may be slightly delayed to a viewer’s screen. 6UP is not timed to the television or radio broadcast of the match but only to the Live 6UP Match.
 
  1. 6UP’s Response to valid Entry
 
    1. Upon receipt of 6UP Entry by the 6UP game engine, 6UP will send You an SMS response. The following explains the meaning of the SMS response You receive:
 
    1. If the SMS response indicates “Entry Accepted”, then Your 6UP Entry has been received and You are entitled to participate in the 6UP Over, subject to the terms and conditions herein.
 
    1. If the response indicates “There is no live 6UP game at the moment.”, Your 6UP Entry was for a non-6UP Over and /or was received after the Cut-off Time for the last 6UP Over of the 6UP Match. Your 6UP Entry will be deemed invalid.
 
    1. If You have any questions regarding 6UP Rules, You should contact 6UP at www.play6up.in.
 
    1. Notwithstanding anything contained herein, if You are not an eligible participant, (please refer to the definition of Eligible Participant) and You play 6UP, any fees or charges charged to You shall not be refunded. Your 6UP Entry will not be valid and will not be considered. If your 6UP Entry is nevertheless accepted for any reason, no prize money is payable to You. In the event any prize-money has been paid inadvertently You must repay the same to 6UP, and the Prize money shall be paid either to the next winner or other winners, or if no other winner is available, then the prize money shall be considered forfeit as donated to nominated charities as may be solely decided by 6UP.
 
    1. 6UP reserves the right to request at any time such information as 6UP deems necessary within the time limit as prescribed by 6UP to satisfy itself that You are an Eligible Participant. If You fail to provide sufficient satisfactory information, 6UP may in their sole discretion declare You as an ineligible Participant. If there are no other winners available, then the prize shall be considered forfeit.

 
    1. 6UP reserves the right in its sole discretion to withhold payment of any amount payable in respect of a winning 6UP Entry, and/or to declare any 6UP Entry void, if 6UP, its agents or service providers believe for any reason that 6UP Match rigging has taken place, as a result of which the integrity of 6UP may be called into question.
 
    1. Discretion will be exercised by 6UP in terms of these terms and conditions to arrive at a decision. Then all such decisions shall be valid, binding, and acceptable to the participants, without any demur, protest or contestation, under any circumstances whatsoever.
 
  1. Prize
 
        1. A 6UP Over shall have a Prize, and the payout shall be made based on the respective Matching Rule.

 

        1. If there is no winner or the Prize money is not exhausted for any particular 6UP Over(s) subject to what is stated elsewhere in these terms and conditions, then the remaining Prize money shall be carried forward to the next 6UP Over, provided that there is at least one 6UP Over remaining in the series.
 
        1. There are no alternatives to the Prizes. The Prizes are not transferable.

     

  1. Declaration of Winners
 

    (a) You will be declared as a winner of 6UP if Your 6UP Entry matches the Matching Rule for a 6UP Over. If more than one valid 6UP Entry is correct as per the Matching Rule of a 6UP Over, then either:

    1. the Prize money multiplied by the Payout Percentage is divided equally between all eligible and valid correct 6UP entries;
    2. in the case that the amount calculated as above is less than the sms rate of charge as outlined above, then all eligible, valid and correct 6UP entries will be appropriately awarded the sms rate of charge as outlined above.
 

      6UP reserves the right to amend the Prize minimum amount at its sole discretion. Changes in the Prize amount will be notified via the 6UP website www.play6up.in. It is the responsibility of the 6UP Game of Skill Participant to refer to the website for notice of such changes. 

    (b) If 6UP determines that your Entry is eligible and is a winning Entry, You will be notified by an SMS from 6UP. You may be required to prove to the satisfaction of 6UP, in its absolute discretion:

    1. subscriber of the mobile connection from which the winning 6UP Entry was sent; and

      (ii) that You are an Eligible Participant.  

    (c) You may be required to provide Identity proof, Residence proof and PAN card photocopy or any other relevant documentary proof deemed fit, at the sole discretion of 6UP. You acknowledge and agree that 6UP has the right to verify the information provided by you. 

  1. All prize money shall be paid by cheque within 90 days of your win. All Income Tax, TDS and any other applicable statutory acts/ rules are applicable while paying you the Prize and any statutory deductions shall be so deducted from the Prize.
 
  1. Prize winners will be notified by SMS within seven (7) days of determination as winners. Return of any prize notification as undeliverable, the participant not being contactable by phone within three attempts and/or failure to claim the prize(s) within 15 days of the prize notification shall result in disqualification of the entry and the sms charge and any prize amount will be forfeited. For details on prize notification, refer to the Specific Rules. Failure to claim a prize as specified in Clause 18 within the time or manner notified may result in disqualification. All entitled winners who qualify as per the Specific Rules receive their prize(s) within 90 days of the date of the determination of winners. Should a winner not receive his/her prize within this time then he/she should contact 6UP directly by email at 6up@iplayup.in. All claimed prize(s) are valid for 180 days from the date of the determination of winners, after which the sms charge and any prize amount will be forfeited. Prizes are non-transferable and there is no cash alternative. 6UP reserves the right to substitute prizes which may not be of equal value at any time.
 
  1. 6UP will contact the winner to collect detailed contact information and a cheque will be sent to the winner by courier (comprising of the winning amount less the applicable taxes). Cheques must be deposited through the winner's bank account within the period of the validity of the prize in accordance with Clause 7(e) above. For prizes equal to or greater than Rs. 5000 (Total cumulative win for a series or through a financial year), 6UP will collect winner’s PAN number in addition to the detailed contact information before a cheque can be generated and dispatched.
 
  1. If an error is made in the calculation or notification of any Prize amount, however caused, 6UP reserves the right to recalculate the Prize amount and to rectify the error. Any valid winning 6UP Entry(ies) will then be paid out of the rectified Prize amount available.
 
  1. The name of each winner of 6UP may be published by 6UP, on the 6UP Website or on another medium selected by 6UP. By playing 6UP, You consent to publication and waive any claim to any remuneration for such publications.
 
  1. If You win 6UP, You win Your prize at Your own risk. You are responsible for all insurance, tax or other costs associated with a 6UP prize. Where Your Entry was submitted from a mobile telephone that is on post-paid plan, the account holder is presumed to be the winner, subject to appropriate proof of eligibility as detailed in the Terms and Conditions and these Specific Rules and such other documents as may be required by 6UP including but not limited to those set out in Clause 7 (b) and (c) above. If sufficient proof is not provided by the claimant who is both the winner and an Eligible Participant, 6UP shall have the absolute right to disqualify such person participation and winning. For concluding that the proof of identity or proof address is correct and appropriate, 6UP decision will be final, conclusive and binding on You.
 
  1. You irrevocably authorize 6UP and/or its organizers to obtain your information (e.g. name, address, etc.) from the cellular mobile service operator(s) to enable 6UP and/or its organizers to arrange to send the prize or any communication to you with regard to the Game. You will indemnify and/or keep indemnified the cellular operators in this regard.
 
  1. Proprietary Rights
 

    The content, organization, graphics, design, compilation, digital conversion, software, services and other matters related to the 6UP Game of Skill are protected under applicable copyrights, trademarks and other proprietary (including, but not limited to, intellectual property) rights. The copying, redistribution or publication of any part of the 6UP Game of Skill is strictly prohibited. By participating in the game or otherwise, You do not acquire ownership rights to any game, content, document, software, services or other materials relating to 6UP. The posting of information or material at the Website does not constitute a waiver of any right in such information and materials by 6UP. 

  1. Warranties/Limitation of Liability
 
  1. Except as explicitly contained in the Terms and Conditions and/ or the 6UP Rules, all warranties, expressed or implied, are disclaimed (including, but not limited to, the disclaimer of any warranties of merchantability, non-infringement of intellectual property and/or fitness for a particular purpose). 6UP and our affiliated parties have no liability whatsoever for your participation of, or inability to participate in the 6UP Game of Skill.

 

  1. 6UP assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of communications.

 

  1. 6UP and/or its affiliated parties are not responsible for any problems, including delay in transmission of SMS, due to equipment or technical malfunction, overloaded or busy servers, lines or telecommunication towers, inadvertent disconnection, including service disruption due to being on roaming network (i.e. International, National and Intra-circle roaming) of such third party service provider network, Acts of God or any other reason whatsoever whether outside 6UP’s control or otherwise, or any combination thereof including but not limited to, injury or damage to an individual's, or resulting from, participating in 6UP and/or materials containing viruses or other malicious code in connection with the website or service.
 
  1. 6UP and/ or its affiliated parties shall not in any manner be responsible for non-receipt of prizes dispatched by courier at the postal address of the Participant collected from such winner. 6UP will not reimburse the winner against any claim of non-receipt whether alleged to be caused by fraud or any other cause. 
 
  1. Change of Terms and Conditions
 

    6UP reserves the right to amend, modify or remove one or more clauses of this 6UP Rules and any information contained herein at any time without prior notice. The updated 6UP Rules will be posted at the Website http://www.play6up.in and at the outlets of our distribution partner. You should regularly check this Website for any and all updates and changes. 

  1. Taxes
 

    You acknowledge and agree that 6UP shall not be held responsible for the calculation, collection or reporting of any value added tax, service tax, or any other tax or fee of whatever nature assessed by any authority pursuant to applicable law in relation to participating in the 6UP Game of Skill. 

    You warrant that you shall comply with all applicable laws and regulations with respect to taxes, and shall indemnify 6UP against any and all damages and costs incurred as a result of your failure to comply with its obligations. 

    The Prize shall be subject to the deduction of Income Tax and any other applicable statutory acts/ rules are applicable for the 6UP Game of Skill.
